[...] But I’ll now acquiesce to this idiocy and never speak publicly of the ordeal again. We did that plenty of that already at Scottsdale City Council in 2005. Bottomline- I don’t know what we could have done any better than we did. Sometimes the good guys don’t always win. But I do know that you can’t negotiate with a terrorist. Ever. That’s one of the prime directives. Once you do, you establish a dangerous precedent. When there is no other option but negotiation, you tell your story before they make you shut up and hope that other people that were in the room to hear it. [...]

Sorry, Sean, for the shitty result. I know how committed you have been to this issue - I think it's awesome that you took matters into your own hands and tried your best to fight for you and your neighbors.

@Christopher:
great minds think alike- we already contacted the Sierra Club and did in fact learn that the construction would endanger wildlife in that historical preserve:

we never did take that info to the EPA though, great suggestion. You should see the stack of RUCO complaints that are already on file against them- they are shady slimeballs that use these same FUD techniques to bulldoze over neighborhoods in securing these permits to build up their empire.

@JesterXL:
we have exhausted every media coersion mechanism I know of as well as the governmental appeal process options we have. We still have the ability to appeal the judicial ruling but that of course takes money and time and our funds were all expended on the litigation we already brought against the city. Short of finding a "sugar daddy" who wants to fund our appeal out of altruism, we are pretty much hosed at this point. The only consolation we have is in that their company will not escape without a black eye publicity-wise from us telling others about what happened.

thanks both you guys for your comments and concern.

What are you and your neihbors recourse/further plans of action?

The trick is in finding an endangered species on the proposed site or near the site that would be affected by the installation, such as an endangered plant having the sun being blocked by the steel wall. Get the EPA involved, should tie it up in red tape for awhile.
